PARADISE TOWNSHIP BOARD OF SUPERVISORS
WORK SESSION MINUTES
NOVEMBER 19, 2018
5:00 P.M.


A work session of the Paradise Township Board of Supervisors was held at the Paradise Township Municipal Building, 5912 Paradise Valley Road, Cresco, PA.

PRESENT:  Gary Konrath, Peter Gonze, Reda Briglia, and Solicitor Prevoznik.

Konrath called the work session to order at 5:00 p.m.

Mt. Airy #1, LLC
Attorney Belardi, David Osborne, and Dr. Frank Browne were present.  Discussion was held on a variety of outstanding issues affecting Mount Airy and its projects, as follows:

1.    NPDES Permit – David Osborne stated that he sent several emails to DEP most recently November 1 and 8, 2018.  He has received no response.  Mr. Osborne stated the last reply he received from DEP on the NPDES Permit was on April 24 when he received an email stating that it was in legal review.  Attorney Belardi stated that he has left messages at the regional office and that he has been told that it is with Attorney Lance Zeyher.  Attorney Belardi stated that he has left messages but has not made contact with Attorney Zeyher.

2.    Greenway Matrix – Jason Smith of Hanover Engineering, provided a list of deficiencies in the proposed final draft of the Mount Airy Greenway Report and Matrix.  Dr. Browne reviewed the remaining deficiencies per Jason Smith’s email dated November 14, 2018. 

Item 1:  Installation of stem protectors on tree plantings along Forest Hills Run.
Dr. Browne stated that the stem protectors have been ordered and will be installed within one month.  Jason Smith noted that this item was a requirement of the Conditional Use agreements and is certainly in the best interest of Mount Airy, since plantings must survive or be replaced.

Item 2:  Treatment of aquatic invasive species in the lake and two downstream ponds.  Dr. Browne stated that Mr. Magda did not see the need to treat the invasive species in the lake.  Dr. Browne stated that it is Mr. Magda’s opinion that the invasive species would die over the winter.  Dr. Browne reported that while invasive species do die over the winter they come back.  He noted that these particular invasive species have been coming back and getting worse.  Dr. Browne stated that he would look at the issue in early spring and make a recommendation for treatment to Mount Airy.  Jason Smith stated that the Operations and Maintenance Plan Agreement requires such treatment and, therefore, it must be done; treatment is not optional.
 
Items 3 and 4:  Providing educational seminar for golf course staff.
Items 3 and 4 were discussed.  Dr. Browne will schedule a seminar with the golf course staff in the spring when they return to work.  Dr. Browne will invite Konrath to the seminar.  Dr. Browne will document the hotel environmental practices in the 2018 Greenway Monitoring Report.   

Item 5:  Implementation of green practices for the entire resort/casino.
Dr. Browne stated he would include steps taken by Mount Airy in the 2018 Greenway Monitoring Report.

Item 6:  Final approval of greenway boundary signage by the Township, with additional signs installed as determined by the Township.
Dr. Browne stated that the signage has been installed for about a year.  Jason Smith will follow up with an inspection. 

Item 7:  Trail signs that accompany brochures need to be installed along trails.
Dr. Browne stated that his office would help Andy Faist with installing the 4 X 4 for the signage. He said the task will be completed by the spring of 2019 at the latest.

Item 8:  Flow data for the WWTP (flow and temperature), consistent with the flow and temperature data provided for the stream stations.
Dr. Browne stated this would be included in the 2018 Greenway Monitoring Report, as well as all future annual reports.  WWTP flow data will not be provided monthly. Temperature data will continue to be reported monthly.
 
Item 9:  Meeting conditions of the Dam Permit for the lake, specifically maintaining minimum flow of discharge and meeting temperature requirements in Forest Hills Run at all times.
Konrath clarified the Station 3 is the middle station.   There was discussion on how the valves to the dam are adjusted and the resulting water temperatures and dissolved oxygen when adjustments are made.  Dr. Browne stated that the first pond is the limiting factor.  Jason Smith recommended that Mt. Airy #1, LLC consider either a siphon or aeration to meet the cold water fishery and Dam Permit requirements.  Dr. Browne submitted his recommendation for 2019 Program for Discharge Management Plan (see attached).  Jason Smith will review those recommendations and work with Dr. Browne to finalize the plan.  After the plan is finalized Attorney Belardi will talk with the owners of Mt. Airy #1, LLC.

Jason Smith provided his comments to the draft final version of the revised “Mount Airy #1, L.L.C. - Operation and Maintenance Plan for Greenway Land and Common Facilities - 2018 Update.”  Dr. Browne will review this updated plan and work with Mount Airy and Jason Smith to finalize the report for formal approval.

Konrath adjourned the work session at 5:59 p.m. and opened the regular meeting.
