REGULAR MEETING MINUTES
SEPTEMBER 21, 2020

Call to Order
Chair Konrath called the meeting to order at 6:00 p.m.
Konrath read the public comment statement “To meet the requirements established by the Office of Open records for virtual meetings, this meeting shall be audio and video recorded via GoToMeeting.com from the initial announcement of the meeting till its end with the exception of the executive session if any, which shall not be recorded. Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand and we will also watch for you on chat, and you will be recognized.”

Approval of Minutes
Motion: Gonze moved and seconded by Briglia to approve the September 9, 2020 Board of Supervisors regular business meeting minutes as presented.
Motion carried 3-0.

Treasurer’s Report
Transue read the Treasurer’s Report.
Motion: Briglia moved and seconded by Gonze to approve the September 21 Treasurer’s Report.
Motion carried 3-0.

Bid Awards
Seven Pines Park Project – The Board discussed the bids received for the Seven Pines Park Project. The lowest bid came in at a total alternate bid of $417,000.00. Briglia updated the Board on cost overruns on the project due to inflation adjustments from the original estimate prepared in 2014 to the 2020 values. Briglia stated that the grant project is underfunded by approximately $66,000.00 plus further possible engineering costs. Briglia stated that she spoke with Supervisor LaBar from Barrett Township regarding whether Barrett Township would contribute funds to this project.  It was previously discussed that Barrett Township may contribute up to an additional $30,000.00 in costs to complete the project.  No decision from Barrett Township on this expenditure has been received by Paradise Township. The Board discussed if the Township could fund any additional costs incurred in the completion of the project. The Board discussed using Open Space funds to cover any additional costs needed to complete the Seven Pines Park Phase 1B Grant Project.
Motion: Gonze moved and seconded by Konrath to allocate up to an additional $70,000.00 from the Open Space funds towards the Seven Pines Park Phase 1B Grant Project.
Motion carried 3-0.
Motion: Gonze moved and seconded by Briglia to award the lowest total alternate bid in the amount of $417,000.00 to Kobalt Construction contingent upon satisfaction of the engineer and solicitor that all required bid documents have been completed and are compliant with the bid requirements.
Motion carried 3-0.

Municibid – Konrath stated the Township received a high bid of $40,226.00 for the 2007 Peterbilt dump truck on the Municibid site by Harold Feezle.
Motion: Gonze moved and seconded by Briglia to accept the highest bid received on Municibid from Harold Feezle for the 2007 Peterbilt dump truck in the amount of $40,226.00.
Motion carried 3-0.

New Business
None.

Planning Commission Items
Outdoor Lighting – The Board briefly discussed the Outdoor Lighting Ordinance. The Board will discuss the Outdoor Lighting at a future meeting.

Wireless Communications Ordinance – The Board discussed the proposed Wireless Communications Ordinance.
Motion: Gonze moved and seconded by Briglia to schedule a public hearing to adopt the proposed Wireless Communications Ordinance at the Board of Supervisors meeting on December 7, 2020 at 6:30 pm.
Motion carried 2-0. (Konrath lost connection in meeting).
Motion: Briglia moved and seconded by Gonze to forward the proposed Wireless Communications Ordinance to the Monroe County Planning Commission upon receiving a final draft from Cohen Law Group.
Motion carried 2-0. (Konrath lost connection in meeting).
Motion: Gonze moved and seconded by Briglia to send the draft of the proposed Wireless Communications Ordinance to Cohen Law Group to put the draft into final ordinance format as well as create the advertisement for the public hearing. The motion also includes the authorization for Solicitor Prevoznik to collaborate with Transue in reviewing and approving the ordinance and the advertisement for the public hearing.

Short Term Rental Ordinance – The Board discussed recommendations from the Planning Commission on the Short-Term Rental Ordinance as outlined in their August 11, 2020 Planning Commission meeting minutes. The Planning Commission recommended to the Board of Supervisors to add additional requirements to obtain a Short Term Rental license under section 114-6 License Requirements such as each owner shall maintain and provide proof of at least $500,000.00 per occurrence in general liability insurance, each owner shall provide proof of current garbage disposal company contracted per property and to add to section 114-8 Fees, Term and Renewal that the applicant provide verification that Hotel and Sales Tax have been paid. The Planning Commission also recommended to the Board of Supervisors to amend the Zoning Ordinance to allow for short term rentals in all districts as a permitted use and those uses are subject to the Short Term Rental Licensing Ordinance and that the Supervisors should also consider adding a general requirement to the zoning ordinance that all taxes have to be paid prior to issuance of the zoning permit.
Motion: Gonze moved and seconded by Briglia to accept the Planning Commission’s recommendations and to advise the Planning Commission to finalize their updates to the Short Term Rental Ordinance and the recommended amendment to the Zoning Ordinance be finalized and returned to the Board of Supervisors for further action.
Motion carried 3-0.

Unfinished Business
Route 191 Easements/Traffic Calming Devices – Konrath stated that Russell Horn from Paradise Falls Lutheran Association was present by way of telephone. Mr. Horn stated that the Board of PFLA did not like the placement of the traffic calming devices as shown on the easements needed for the installation of the devices. Konrath recommended to Mr. Horn that he speaks to Charles Unangst or Jim Milot from Hanover Engineering in regard to the placement of the devices.

Briglia left the meeting at 6:48 p.m.

Sopko Redistricting Request – Gonze stated that he spoke to Dave Brown from the Planning Commission and Mr. Brown was questioning if the map provided to him from Charles Unangst in regard to the redistricting was an official map. Transue stated that she copied that map from Paradise Township’s official zoning map. Transue stated that she would confirm with Mr. Brown that it was an official zoning map copy.

Reports
Solicitor – Solicitor Prevoznik had no further reports.
Engineer – Mr. Unangst was not present.

Correspondence/Miscellaneous
Poll Workers Needed – Konrath stated that Transue received a phone call from Cheryl Phillips, Judge of Elections stating that she needed poll workers for the upcoming General Election on November 3, 2020. Transue stated that she would send out a notification on Savvy Citizen and also post it on the website requesting volunteers.

Bear Proof Dumpster – Transue stated that she received an email from Denise Doremus, PMREMS Executive Director requesting a bear proof dumpster at the Woodland Road EMS building as they have had numerous issues with bears tearing garbage out of the dumpster and making a mess on the ground. Transue will look further into obtaining a bear proof dumpster for the Woodland Road EMS building.
