REGULAR MEETING MINUTES
JANUARY 15, 2018

Call to Order

Vice Chair Gonze called the meeting to order at 6:11 p.m.   

Roll Call
Officials Present:

Pledge of Allegiance
Gonze led the Pledge of Allegiance to the Flag.
                             
Public Comment Statement
Gonze read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”
Gonze stated that the meeting is being recorded for the limited purpose of preparing the official minutes.

Executive Session
Gonze stated that an Executive Session was held on January 5 at 2:30 p.m. for personnel issues and that no decisions were made. 

Approval of Minutes
Motion: Gonze moved and seconded by Briglia to approve the January 2, 2018 Board of Supervisors Organization meeting minutes as presented.
Motion carried 2-0.
Motion: Gonze moved and seconded by Briglia to approve the January 2, 2018 Board of Supervisors regular meeting minutes as presented.
Motion carried 2-0.
Treasurer’s Report
Briglia submitted the Treasurer’s Report. 
Motion:  Gonze moved and seconded by Briglia to approve the treasurer’s report as presented.
Motion carried 2-0.

Work Session Items
Contract for Professional Services
Gonze stated that a Contract for Professional Services was discussed at the work session held earlier this evening.  The Contract for Professional Services would be used to enter into an agreement with a developer to have certain plans, drawings, engineering studies, reviews and other documents reviewed by the Township and Township professionals prior to formal land development on subdivision plans being submitted to the Township.
Motion:  Gonze moved and seconded by Briglia to approve the use of the Contract for Professional Services as stated above.
Motion carried 2-0.
QuickBooks
Gonze stated that Briglia has informed the Board that QuickBooks will need to be updated prior to April to continue to receive updates for payroll. 
Motion:  Gonze moved and seconded by Briglia to have Jason Farr, Supertech, upgrade QuickBooks.
Motion carried 2-0.
 
Planning Commission Items
Gonze stated that the Planning Commission items including nuisance vehicles, wireless communication facilities and uses were discussed at the work session held earlier this evening. 

Unfinished Business
Mt. Airy #1, LLC/Amended Development and Stormwater Management Agreements
Attorney Belardi was present for Mt. Airy #1, LLC.  Attorney Belardi stated that Solicitor Prevoznik and he have worked on completing the agreements along with the exhibits.  Solicitor Prevoznik stated that the agreements could be approved contingent on final review of the cost estimate for the stormwater agreement.
Motion:  Gonze moved and seconded by Briglia to approve the Amended Development and Stormwater Agreements and Exhibits contingent on final review and approval of the cost estimate for the Stormwater Agreement by Hanover Engineering.
Motion carried 2-0.
Mt. Airy #1, LLC/Amendment #4 to the Conditional Use Permit
Attorney Belardi stated that a Conditional Use Permit Application has been submitted for the construction of a permanent tent for Parking Lot D Outdoor Venue.  Brady stated that a conditional use hearing should be scheduled for the Board of Supervisors second meeting in February.
Motion:  Gonze moved and seconded by Briglia to schedule the Conditional Use Public Hearing for Wednesday, February 21 at 6:30 p.m.
Motion carried 2-0.
Mt. Airy #1, LLC/Snow Removal on Woodland Road
Gonze stated that the Township has received notification that Mt. Airy #1, LLC was doing snow removal on Woodland Road.  Gonze agreed to speak with Mader regarding snow plowing of Woodland Road. 
Mt. Airy #1, LLC/Stream Monitoring Report
Mrs. Stevens was present and stated that an email was received this afternoon from Frank Browne with the stream data for December 2017.   Mrs. Stevens submitted the report to the Board.  Mrs. Stevens stated that Station 3 shows the flow below the required minimum flow for several days.  Attorney Belardi will ask Mr. Browne to respond on why the minimum flow was not met. 
Mt. Airy #1, LLC/Trail Monitoring Report #1
Gonze stated that David Osborne has submitted a maintenance schedule for the Trail Monitoring Report and that a maintenance schedule will be included in all future reports.  Mrs. Stevens stated that the Environmental Advisory Council (EAC) has requested that the trails be inspected every six (6) months.  Mr. Unangst stated that according to the notes on the approved Mt. Airy Trails Plans that the monitoring schedule has been established to provide three inspections for the first two years followed by bi-annual monitoring inspections after the initial two years.    
Mrs. Stevens stated that the EAC also discussed that the Township should be notified of trees down, hunting, and trail damage for the Township to report to Mt. Airy.  After discussion the Board agreed that whomever found the issues should report directly to Mt. Airy security as previously agreed upon between the Township and Mt. Airy.  Briglia requested that Attorney Belardi provide the direct number for Mt. Airy security.      
Mt. Airy #1, LLC/Discharge Monitoring Report
Mr. Unangst reported that two of the Discharge Monitoring Reports have the same revised date of December 14, 2017.  The change that was made to Page 7 of the Discharge Monitoring Report after the December 15, 2017 Board of Supervisors meeting should be changed on the cover page to Revised December 16, 2017.
Auditor Vacancy
Briglia stated that the auditor’s position is vacant as of January 1, 2018 and that the Board would has thirty (30) days to fill the vacancy.  Briglia stated that no letters of interest have been received.
  
New Business
Pocono Wildlife Rehabilitation/Donation Request
Gonze summarized the letter from Pocono Wildlife Rehabilitation requesting a donation of $300.00.  Briglia stated that she did not find anything in the second-class township code that would permit a donation to a wildlife rehabilitation center.  Gonze requested that this be placed on the next Board of Supervisors agenda for further discussion.
Deputy Tax Collector 
Briglia stated that Mary Grace DeHaven submitted the Deputy Tax Collector Form naming Patricia Michael as the Deputy Tax Collector for Paradise Township.
Motion: Gonze moved and seconded by Briglia to approve the Deputy Tax Collector Form naming Patricia Michael as the Deputy Tax Collector.
Motion carried 2-0.
Peterbilt Truck and Snow Plow
Mader provided quotes from Hunter Peterbilt for a 2018 Peterbilt Model 348 through CoStars for $94,685.00 and from E. M. Kutz, Inc. for the dump body, snow plow hitch, spreader, hydraulics, lighting and miscellaneous through CoStars for $73,673.00.
Motion:  Gonze moved and seconded by Briglia for Mader to order the 2018 Peterbilt Model 348 through Hunter Peterbilt and dump body and accessories through E. M. Kutz as submitted.
Motion carried 2-0.  

Reports
Solicitor – Solicitor Prevoznik stated that he has been working with Attorney Charles Vogt on finalizing the open space property acquisition agreement of sale.  Solicitor Prevoznik stated that he has not heard from the attorney for Skelly Loy Engineering that is reviewing the proposed changes to the contract.  Brady recommended that Skelly Loy Engineering be sent a final notice letter that if the contract is not provided that the Township will move forward with another engineering firm.
Motion:  Gonze moved and seconded by Briglia for Solicitor Prevoznik to send a final notice letter to Skelly Loy Engineering.
Motion carried 2-0.
Engineer – Mr. Unangst stated that Mader and he would be meeting with the contractor for Mt. Airy #1, LLC to discuss traffic control during construction on Tuesday, January 23 at 10:00 a.m. 
EAC/Open Space – The Board discussed the EAC report.  The EAC has requested that an article be included in the upcoming newsletter asking for volunteers for the Carlton Road Clean Up scheduled for Saturday, April 28.  The Board of Supervisors will have Kathleen Kelly include an article in the upcoming newsletter requesting volunteers for the Carlton Road Clean Up and ask for volunteers to schedule clean up of other Township roads.  Gonze suggested that the EAC consider making the road clean ups a community event with more publicity for next year.
