PARADISE TOWNSHIP BOARD OF SUPERVISORS
REGULAR MEETING MINUTES
FEBRUARY 21, 2018

Call to Order

Chair Konrath called the meeting to order at 6:00 p.m.   

Roll Call
Officials Present:

Pledge of Allegiance
Konrath led the Pledge of Allegiance to the Flag.   
                             
Public Comment Statement
Konrath read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”
Konrath stated that the meeting is being recorded for the limited purpose of preparing the official minutes.

Approval of Minutes
Motion: Konrath moved and seconded by Briglia to approve the February 5, 2018 Board of Supervisors regular meeting minutes as presented.
Konrath-aye, Briglia-aye, Gonze-abstained (absent on 2/5).

Treasurer’s Report
Briglia submitted the Treasurer’s Report. 
Motion:  Gonze moved and seconded by Konrath to approve the treasurer’s report as presented.
Motion carried 3-0.

Executive Session
Konrath stated that an Executive Session was held earlier this evening for real estate issues and that no decisions were made. 

Work Session Items
Konrath stated that the Paradise Township Web Page was discussed at the work session held earlier this evening.

Unfinished Business
Pocono Wildlife Rehabilitation Request for Donation
The Board discussed the request for the Pocono Wildlife Rehabilitation and Education Center for a donation of $300.00.  Konrath stated that he thought the donation could be made according to Section 2203 of the Second-Class Township Code allowing appropriation of funds for recreation programs not directly sponsored by the Township.  Gonze stated that he thought it would also be allowed according to Section 1531 of the Second-Class Township Code allowing appropriation of funds to animal shelters. 
Motion:  Konrath moved and seconded by Gonze to appropriate $300.00 to the Pocono Wildlife Rehabilitation and Education Center.

Nothstein Preserve
Konrath submitted a map of the trails currently on the Nothstein Preserve.  Konrath stated that a bridge is needed on the west side of the trails and requested that Hanover Engineering submit a permit application to the Pa. Department of Environmental Protection (DEP) for a pedestrian bridge.
Motion:  Briglia moved and seconded by Gonze for Hanover Engineering to submit a permit application to the DEP for a pedestrian bridge on the Nothstein Preserve.
Motion carried 3-0.

Pa. Municipal Retirement System (PMRS) Revised Ordinance
Solicitor Prevoznik recommended that the Board of Supervisors arrange a conference call with Joshua Vecchio at PMRS to discuss the revised ordinance.
Motion:  Konrath moved and seconded by Briglia to table the PMRS revised ordinance until a conference call with Joshua Vecchio is held.
Motion carried 3-0.

Koerners Road Bridge Rehabilitation Bid Results
Mr. Unangst submitted the bid results received by Hanover Engineering through PennBid for the Koerners Road Bridge Rehabilitation. Briglia read the bids.  (See Exhibit 1). 
Motion:  Gonze moved and seconded by Konrath to table the bid award until the bid packages can be reviewed by Solicitor Prevoznik and Hanover Engineering.
Motion carried 3-0.
Mr. Unangst stated that Hanover Engineering will notify the bidders that the award of the bids have been postponed. 
 
New Business
Paradise Historical Society Request to Waive “Roof” Rental Fee
Konrath stated that the Paradise Historical Society submitted a letter requesting that the
“Roof” rental fee be waived for their barbecue/potluck dinner on Sunday, July 8. 
Motion:  Gonze moved and seconded by Konrath to waive the “Roof” rental fee for the Paradise Historical Society’s barbecue/potluck dinner.
Motion carried 3-0.

Timber Hill Community Association/Request Speed Limit Reduction and No Outlet Sign
Konrath summarized the letter from Timber Hill Community Association requesting a speed limit reduction on Timber Hill Road and a no outlet sign.  Briglia stated that a no outlet sign may interfere with the Liquid Fuels monies received for Timber Hill Road.  Briglia asked if a traffic study would need to be completed to consider reducing the speed limit. 
Motion:  Gonze moved and seconded by Briglia to authorize Hanover Engineering to research reducing the speed limit and a no outlet sign.
Motion carried 3-0.

Timber Hill Community Association/Burned Out Structure
Brady stated that Timber Hill Community Association is requesting the Township become involved in removing the burned out structure at 308 Sugarbush Road.
Motion:  Gonze moved and seconded by Briglia to authorize Solicitor Prevoznik to research the Township’s options.
Motion carried 3-0.

PennDOT Connects
Konrath stated that PennDOT will be holding two-hour municipal outreach sessions to discuss the PennDOT Connects Initiatives.  The Board discussed who should attend.  Mr. Unangst stated that he would be attending the PennDOT outreach session on February 27.  Mr. Unangst will update the Board on the PennDOT Connects Initiatives program.
 
Zoning Course and PSATS Convention/Donna Alker
Briglia stated that Donna Alker, Planning Commission Member, has requested that the Township pay for her to attend the Zoning Course at Middle Smithfield Township and the PSATS Convention.  Briglia noted that Donna Alker is the Planning Administrator/Staff Engineer for Stroud Township.
Motion:  Briglia moved and seconded by Gonze not to approve Donna Alker’s request for Paradise Township to pay for her to attend the Zoning Course and PSATS Convention as the courses are more relevant to her position at Stroud Township.
Motion carried 3-0.

Mt. Airy #1, LLC Public Hearing Conditional Use Amendment #4
Motion:  Konrath moved and seconded by Briglia to recess the regular meeting and open the public hearing at 6:30 p.m.
Motion carried 3-0.
Solicitor Prevoznik summarized the Public Notice for the Mt. Airy #1, LLC Conditional Use Amendment #4 Hearing.  (See Exhibit 2.)

Motion:  Konrath moved and seconded Gonze to continue the Mount Airy #1 LLC Conditional Use Amendment #4 Hearing to March 13 at 5:00 p.m.
Motion carried 3-0.

Motion:  Konrath moved and seconded by Gonze to reconvene the regular meeting.
Motion carried 3-0.

Unfinished Business (Continued)
Mr. Osborne presented emails from Michael Luciani regarding the permit for the splitter box.  Mr. Osborne stated that per his emails with Mr. Luciani that a permit will not be required.  Mr. Osborne is waiting to receive a letter from Mr. Luciani stating that no permit is required.  Attorney Belardi requested that the matrix for Mt. Airy #1 be revised to show that the splitter box will be installed on or before March 31.
Motion:  Gonze moved and seconded by Briglia to extend the installation date of the splitter box on the Mt. Airy #1 matrix to March 31, 2018.
Motion carried 3-0.

Reports
Solicitor – Solicitor Prevoznik stated that he had no further report.
Engineer – Mr. Unangst stated that he had no further report.
EAC/Open Space – Konrath asked if the Board had any questions on the EAC meeting minutes.  There were no questions.

Planning Commission Items
Mt. Airy #1, LLC Outdoor Venue Preliminary/Final Land Development Plan
Motion:  Gonze moved and seconded by Briglia to table the Mt. Airy #1, LLC Outdoor Venue Preliminary Final Land Development Plan.
Motion carried 3-0.

Correspondence/Miscellaneous
There was no correspondence/miscellaneous.

Other Business/Public Comment
There was no further business or public comment.
