REGULAR MEETING MINUTES
OCTOBER 15, 2018

Call to Order

Vice Chair Gonze called the meeting to order at 6:01 p.m.   

Roll Call

Pledge of Allegiance
Gonze led the Pledge of Allegiance to the Flag.   
                             
Public Comment Statement
Gonze read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”
Gonze stated that the meeting is being recorded for the limited purpose of preparing the official minutes.

Approval of Minutes
Motion: Gonze moved and seconded by Briglia to approve the October 3, 2018 Board of Supervisors regular meeting minutes as presented.
Motion carried 2-0.

Treasurer’s Report
Briglia submitted the Treasurer’s Report.
Motion:  Gonze moved and seconded by Briglia to approve the treasurer’s report as presented.
Motion carried 2-0.

Unfinished Business
ClearLane Purchase/Budget Line Item Transfer
The Board discussed the purchase of ClearLane under the current bid through Pocono Mountain Council of Governments good through December 31, 2018.  Briglia stated that monies can be transferred from Line Item 438.60 to 432.24.  Briglia clarified that this in addition to the motion made at the October 3 Board of Supervisors meeting to approve purchasing salt in the amount of $40,000.00. 
Motion:  Gonze moved and seconded by Briglia to transfer $40,000.00 from Line Item 438.60 to 432.24 for the purchase of ClearLane.
Motion carried 2-0.
State Route 191 and Rogues Path and State Route 191 and Browns Hill
The Board discussed the email from Senator Scavello’s office requesting the Township to purchase, install, and maintain radar speed signs in both directions near the intersections of Route 191 and Browns Hill Road and Route 191 and Cranberry Creek Road.  The Board also discussed the email from Sara Robacker, PennDOT, to purchase, install, and maintain a “Side Road Warning” sign on southbound Route 191 prior to Rouges Path Road. 
Motion:  Gonze moved and seconded by Briglia to have Hanover Engineering provide plans that would include the radar speed signs in both directions as well as a hidden road sign near Rogues Path road. The plan needs to include costs for acquisition, specific and optimal location as well as the required inter and permits from PennDOT.    
Motion carried 2-0.
  
New Business
Monroe County Conservation District/Dirt and Gravel/Low Volume Class to be Scheduled
Briglia explained that the MCCD has been administering the State Conservation Commission’s Dirt and Gravel Road Program since its inception in 1997 and that in 2013 the MCCD entered into a new 5-year agreement which enabled the program to provide grant funding for low volume paved roads as well.  Briglia stated that to be eligible for the grants that a township employee must be trained in Environmentally Sensitive Maintenance.  Briglia stated that the MCCD is now in the process of scheduling 2019 training in Monroe County and recommended that the Board approve an employee attending the training.  There was a brief discussion on who should attend. 
Motion:  Gonze moved and seconded by Briglia to approve two employees to attend the Environmentally Sensitive Maintenance training when it becomes available in Monroe County.
Motion carried 2-0.  
Mt. Airy #1, LLC/Stream Data for September
The Board reviewed the stream data submitted by Frank Browne for September.  The stream flow in September ranged from 3.78 cfs to 25.78 cfs which meets the required stream flow of 0.375 cfs.  The temperature data submitted shows that the stream temperature exceeded the stream criteria at the upstream station for 47.5 hours, the midstream station for 616.5 hours, and the downstream station for 651.75 hours.
Motion:  Gonze moved and seconded by Briglia to send a letter submitting the stream temperature data to the DEP, Fish and Boat Commission and copying the Brodhead Watershed Association, PennFuture, Mount Airy #1, LLC and Attorney Jeffrey Belardi as a follow-up to the letter sent to these entities on September 17, 2018.
Motion carried 2-0.
Work Session with Mt. Airy #1, LLC Scheduled for November 19 – Discussion Items
Briglia stated that a tentative agenda for the work session with Mt. Airy #1, LLC should be prepared listing the items that the Board wishes to discuss.  The Board reviewed items to be included on the agenda which include the Conditional Use Matrix, Stream Data Reports, Greenway Monitoring Report, Trail Maintenance and the NPDES Permit.  Solicitor Prevoznik requested that he be approved to work with Jason Smith and Charlie Unangst on the agenda items.  Solicitor Prevoznik will then send the tentative agenda items to the Board, Frank Browne, Attorney Belardi and Dave Osborne.
Motion:  Gonze moved and seconded by Briglia to approve Solicitor Prevoznik reviewing all items with Jason Smith and Charles Unangst.
Motion carried 2-0.

Planning Commission Items
Proposed Ordinances
Fireworks
Brady reviewed the proposed chapters on fireworks.  Chapter 1 contains a definition for display fireworks and Chapter 64 replaces the existing chapter that incudes consumer fireworks and display fireworks.  Brady stated that both proposed ordinances have been recommended for adoption by the Paradise Township Planning Commission.  Brady requested that the public hearings for the proposed ordinances be scheduled.
Motion:  Briglia moved and seconded by Gonze to schedule and advertise proposed Chapter 1 and Chapter 64 public hearings for December 17 at 6:30 p.m. and 6:45 p.m. respectively.
Motion carried 2-0.
Short-Term Rentals
Brady reviewed the proposed chapters on short-term rentals.  Chapter 114-7 changes the short-term rental standards and Chapter 114 is to revise the fee schedule to include an appeal fee.  Brady stated that both proposed ordinances have been recommended for adoption by the Paradise Township Planning Commission.  Brady stated that both ordinances have been submitted to the Monroe County Planning Commission for review.  Brady requested that the public hearings for the proposed ordinance be scheduled.
Motion:  Briglia moved and seconded by Gonze to schedule and advertise proposed Chapter 114-7 and Chapter 114 for December 3 at 6:30 p.m. and 6:45 p.m. respectively.

Explosives
Brady reviewed the proposed changes to Chapter 160-21.  Solicitor Prevoznik recommended changes to Paragraph 2 regarding the certificate of insurance.  Brady will work with Solicitor Prevoznik on the recommended changes and return to the Paradise Township Planning Commission for review.
Nuisance Vehicle
Brady reviewed the proposed changes to Chapter 146-2.  There was discussion on how many nuisance vehicles would be allowed before it is a junkyard, enforcement and citation, and oil and antifreeze leaks.   Brady will work with Solicitor Prevoznik on the recommended changes and present to the Paradise Township Planning Commission for review.       
Traffic Impact Study
Brady reviewed the proposed changes to Chapter 160-20.  There was discussion on required levels of service.  Solicitor Prevoznik recommended changes to this paragraph.  Brady will work with Solicitor Prevoznik on the changes and return to the Paradise Township Planning Commission for review. 
Joint Planning Commission/Board of Supervisors
Brady recommended that a joint meeting be held with the Board of Supervisors and the Planning Commission.
Motion:  Briglia moved and seconded by Gonze to schedule and advertise a special meeting with the Planning Commission and Board of Supervisors on December 3 at 5:00 p.m.
Motion carried 2-0.   

Reports
Solicitor – Solicitor Prevoznik submitted the license agreement between the Huggards and Paradise Township for access to the Paradise Lutheran and Presbyterian Church Cemetery for signatures.  Solicitor Prevoznik reported that Brady, Briglia and himself had a conference call with Attorney Dan Cohen, Cohen Law Group, regarding the wireless communication facilities proposed ordinance.  Attorney Cohen has submitted a wireless facility management scope of services to review and revise the current proposed ordinance.  Attorney Dan Cohen submitted an engagement letter to be signed by the Board for Cohen Law Group to amend the proposed ordinance for $3,950.00.
Motion:  Briglia moved and seconded by Gonze to approve the engagement letter for $3,950.00.
Motion carried 2-0. 
EAC/Open Space – Briglia stated that Konrath had no report for tonight’s meeting.

Correspondence/Miscellaneous
Gonze asked if Briglia knew how many metal dumpsters were used for fall clean-up.  Briglia stated that Mader has not submitted the dumpster information yet.

Other Business/Public Comment
Shawn Garber was present and stated that the Browns Hill Bridge appears to be washing out around the riprap on the upper side of the bridge coming down Browns Hill Bridge.
Motion:  Briglia moved and seconded by Gonze for Hanover Engineering to inspect Browns Hill Bridge for washout.
