REGULAR MEETING MINUTES
JANUARY 7, 2019

Call to Order

Chair Konrath called the meeting to order at 5:45 p.m.   

Roll Call
Officials Present:

Approval of Minutes
Motion: Gonze moved and seconded by Konrath to approve the December 17, 2018 Board of Supervisors regular meeting minutes as presented.
Motion carried 3-0.

Unfinished Business
Hanover Engineering/Jason Smith – Riparian Buffer Inspection Letter
The Board reviewed the letter from Jason Smith regarding the riparian buffer inspection for Mount Airy Casino and Resort.
Motion:  Briglia moved and seconded by Gonze to accept the letter as submitted.
Motion carried 3-0.
Solicitor Prevoznik stated that this letter would be included in the Greenway Monitoring Report.  Solicitor Prevoznik also recommended that time frames for items to be completed be included in the reports.
Motion:  Briglia moved and seconded by Gonze for Hanover Engineering to contact Dr. Browne to include time frames for items to be completed in future reports.
Motion carried 3-0.

Paid Time Off – Employee Counseling
The Board discussed paid time off for the employees involved in the November 27 incident.  The Board agreed to review this as future counseling is requested by the employees.  Solicitor Prevoznik recommended that the previous time off be submitted to Selective Insurance for reimbursement.  Briglia stated that she would follow-up with Selective Insurance.

New Business
2019 Proposed Community Function Dates
The Board reviewed the proposed community function dates (See Exhibit 1).  Briglia reminded the Board that Michael Mader has recommended that Senior Pick-Up start on Monday instead of Tuesday due to the amount of pick-ups. 
Motion:  Briglia moved and seconded by Gonze to approve Senior Pick-Up to be scheduled for both the spring and fall clean ups to include Mondays.
Motion carried 3-0.
Motion:  Konrath moved and seconded by Briglia to approve the proposed 2019 community function dates as submitted.
Motion carried 3-0. 

Proposed Ordinance Chapter 67 (Fire Insurance Escrow) -- Schedule Public Hearing
Brady stated that proposed ordinance Chapter 67 has been recommended for adoption by the Paradise Township Planning Commission.
Motion:  Briglia moved and seconded by Gonze to schedule a public hearing for the proposed ordinance Chapter 67 for March 18 and 6:30 p.m.
Motion carried 3-0.

Proposed Ordinance Chapter 160 (Explosives) -- Schedule Public Hearing
Brady stated that proposed ordinance Chapter 160 has been recommended for adoption by the Paradise Township Planning Commission.  Brady stated that the proposed ordinance would also need to be sent to the Monroe County Planning Commission for review.
Motion:  Gonze moved and seconded by Briglia to schedule a public hearing for the proposed ordinance chapter 160 for March 18 at 6:45 p.m.
Motion carried 3-0.

Reports
Solicitor – Solicitor Prevoznik stated that he had no report.

Roadmaster – Gonze summarized the roadmaster’s report.  There was discussion on the quote from Cleveland Brothers to replace the defective H100 generator controller as necessary and perform any and all programming/setup required, run unit and confirm panel operation.  Shawn Garber was present and asked if a computer could be hooked up to the generator without replacing the controller for a read out.  There was also discussion on work that has previously been done on the generator.  After further discussion Mr. Unangst was instructed to speak with Mike Mader and then to contact Cleveland Brothers for more information.
 
Zoning Officer – Brady stated that the Planning Commission is working on the proposed traffic study impact ordinance. 
 
Engineer – Mr. Unangst stated that Hanover Engineering would be looking at the site for the new salt storage building and the site distance for the driveway for the Paradise Discovery Park.  Mr. Unangst stated that he has met with Logan Evans regarding a generator for the Pocono Mountain Volunteer Fire Company station and will be following up on the quote received by Logan Evans.  Mr. Unangst stated that Briglia had also spoken to him regarding reviewing the Discharge Monitoring Reports that are currently received by the Township.  After discussion, the Board agreed that it is no longer necessary to receive the DMR’s as they are available on line.

PARC – Briglia stated that no meetings were held in November or December and that the next meeting would be on January 24.
Pocono Mountain Regional Emergency Medical Services (PMREMS) – Gonze stated that the December meeting was cancelled due to weather, but the Executive Committee met and passed the budget to be ratified at the next PMREMS Board Meeting.  Gonze stated that the budget shows a small surplus.  Gonze reported that Medicaid has increased the contractual allowance however it still does not cover the cost of transport.  Gonze reported that PMREMS is also looking at improvements at the 11-1 Tobyhanna station.  Gonze stated that Chad Nauman had contacted him regarding repairs to the water hose spigot at the 11-3 Paradise station.  Gonze will follow-up with Nauman regarding the repairs.

Correspondence/Miscellaneous
Gonze stated that he attended the Pocono Mountain Council of Governments workshop regarding municipal building security.  After discussion, Gonze and Konrath will meet with the office staff to discuss municipal building security this week.

Public Hearing Proposed Ordinance 254
Motion:  Konrath moved and seconded by Gonze to recess the regular meeting and open the public hearing for proposed Ordinance 254 at 6:30 p.m.
Motion carried 3-0.
Proposed Chapter 1 – Definitions
Solicitor Prevoznik stated that the purpose of Ordinance #254 is to establish a fee for an appeal of a determination of the Zoning Officer to the Paradise Township Board of Supervisors under Chapter 114.  Solicitor Prevoznik stated that the proposed ordinance was scheduled for December 3 at 6:30 at which time it was continued to a date and time certain which was tonight at 6:30 p.m.  Solicitor Prevoznik summarized the advertised public notice for proposed Ordinance #254 (See Exhibit 2).  Solicitor Prevoznik called Debra Brady to testify.  Brady submitted the following Exhibits:

Solicitor Prevoznik asked if the Board had any questions.  The Board had no questions.  Solicitor Prevoznik asked if any member of the public wished to discuss the Ordinance.  No one participated or signed the sign-in sheet.
Motion:  Gonze moved and seconded by Briglia to move Exhibits 1 – 8 into the record.    Motion carried 3-0.
Motion:  Gonze moved and seconded by Briglia to close the public hearing and reconvene the regular meeting at 6:34 p.m.
Motion carried 3-0.
Motion:  Briglia moved and seconded by Gonze to adopt Ordinance #254 as advertised.
Motion carried 3-0.

Other Business/Public Comment
Gonze reported that an email was received on January 3 from Jason Farr, Supertech, that the local backup drive is full.  Jason Farr submitted a cost estimate of $825.00 for an expansion backup drive and installation.
Motion:  Gonze moved and seconded by Briglia to ratify ordering and installing the expansion backup for $825.00.
Motion carried 3-0.
Gonze reported that Shawn Garber reported earlier that the washout at the Browns Hill Bridge is getting worse.  Mr. Unangst will take another look at the washout and possibly recommend removal of the rock in the stream to prevent further washout of the bank.

Public Hearing Proposed Ordinance 255
Motion:  Konrath moved and seconded by Briglia to recess the regular meeting and open the public hearing for proposed Ordinance 255 at 6:45 p.m.
Motion carried 3-0.
Proposed Chapter 114 – Short Term Rentals
Solicitor Prevoznik stated that the purpose of Ordinance #255 is to amend the existing Chapter 114 to clarify and augment specific health and safety requirements to meet the requirements of the 2009 Intonation Residential Code, to wit: interconnected smoke detectors with battery backup; arc fault circuit breakers, GFI outlets in all unfinished basements and garages; compliant stairs and handrails, emergency egress windows; and adequate fire separation between attached garages and dwelling units.  Solicitor Prevoznik stated that the proposed ordinance was scheduled for December 3 at 6:45 at which time it was continued to a date and time certain which was tonight at 6:45 p.m.  Solicitor Prevoznik summarized the advertised public notice for proposed Ordinance #255 (See Exhibit 3).  Solicitor Prevoznik called Debra Brady to testify.  Brady submitted the following Exhibits:
