REGULAR MEETING MINUTES
APRIL 1, 2019

Call to Order

Chair Konrath called the meeting to order at 6:00 p.m.   

Roll Call
Officials Present:

Pledge of Allegiance
Konrath led the Pledge of Allegiance to the Flag.   
                             
Public Comment Statement
Konrath read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”
Konrath stated that the meeting is being recorded for the limited purpose of preparing the official minutes.

Approval of Minutes
Motion: Gonze moved and seconded by Konrath to approve the March 18, 2019 Board of Supervisors regular meeting minutes as presented.
Motion carried 3-0.
Motion: Gonze moved and seconded by Konrath to approve the March 20, 2019 Public Hearing minutes as presented.
Motion carried 3-0.
Motion: Gonze moved and seconded by Konrath to approve the March 26, 2019 Public hearing minutes as presented.

Motion carried 3-0.

Motion: Gonze moved and seconded by Konrath to ratify the Public Hearing advertisement for Tarpon Towers that was published in the Pocono Record on March 22, 2019.
Motion carried 3-0.

Executive Session
Konrath announced that an executive session was held on March 26, 2019 to discuss the laws pertaining to the Conditional Use Hearing for Tarpon Towers.  Konrath stated that no decisions were made.

Work Session Item
Konrath stated that the Zoning Officer position was discussed at the work session earlier this evening.  Jake Schray, Hanover Engineering, will be the interim Zoning Officer.
Motion:  Gonze moved and seconded by Konrath to direct the current Zoning Officer to provide Jack Schray an up-to-date Code of Ordinance Book and to place the Code of Ordinance onto the Township’s shared drive.   
Motion carried 3-0.

Executive Session
Konrath stated that executive sessions have been scheduled for either or both April 12 and April 15 for Zoning Officer interviews. 

Spring Clean-Up
Briglia stated that the Spring Clean-Up advertisement for quotes was published in the Pocono Record on March 11 and March 18.  Briglia stated that one quote was received from J.P. Mascaro & Sons for $27.00 for trash and $20.00 for metal.
Motion:  Gonze moved and seconded by Briglia to award the Spring Clean-Up quote to J. P. Mascaro & Sons for $27.00 for trash and $20.00 for metal.
Motion carried 3-0.

Unfinished Business
PPL Utilities Right-of-Way at Ice Lake
Solicitor Prevoznik stated that he has spoken with Ron Borger and that he will be sending a more definitive easement for the right-of-way at Ice Lake.
Monroe County Public Safety Center/Emergency Operation Plan
Briglia stated that Kevin Transue and she met with Lynda Messerschmidt from the Monroe County Office of Emergency Management to review the update to the Emergency Operations Plan for Paradise Township.  Briglia stated that Mader is working on updating the equipment list and type of vehicles required for the Emergency Operations Plan.
Savvy Citizen
The Board discussed the Savvy Citizen application for notifying residents of upcoming meetings and events.  The Board discussed the pros and cons of using Savvy Citizen for keeping Paradise Township residents informed on meetings and events.
Motion:  Gonze moved and seconded by Briglia to join Savvy Citizen for the annual cost of $990.00 and the $300.00 one-time marketing set-up fee.
Motion carried 3-0.
Hanover Engineering/Jake Schray/Office Hours
The Board discussed regular office hours for Jake Schray as interim zoning officer.  Briglia stated that she had spoken with Jack Schray who agreed that Tuesday and Friday mornings from 8:00 to 9:30 a.m. would be good since it is the same time that Building Inspections Underwriters has office hours.
Motion:  Gonze moved and seconded by Konrath to approve Jake Schray office hours for Tuesday and Friday mornings from 8:00 to 9:30 a.m. and by appointment.
Motion carried 3-0.

New Business
Road Materials Bid/Approve Advertising
Konrath stated that Briglia submitted the road materials bid advertisement to be published in the Pocono Record on April 8 and April 15, the bid opening on May 2, 2019 at 10:01 a.m. by committee, and with the bid award scheduled for May 6, 2019 at 6:15 p.m.
Motion: Gonze moved and seconded by Konrath to approve the road materials advertisement as submitted.
Motion carried 3-0.
Road Paving Project Bid/Approve Advertising
Briglia stated that Mader met with Jeff Roback, PennDOT Municipal Representative, today and completed the road paving project bid specifications.  Briglia stated that the road paving project bid advertisement would be published in the Pocono Record on April 15 and April 22, the bid opening on May 22 at 6:15 p.m., and the bid award scheduled for May 22 immediately following the bid opening.  Mader stated that the road paving project would include Cranberry Creek, Henrys Crossing and a portion of Red Rock Roads.
Motion:  Gonze moved and seconded by Konrath to approve the road paving project advertisement as submitted.
Motion carried 3-0.

Reports
Roadmaster – Mader summarized his report.   
Engineer – Mr. Unangst distributed the salt shed mixing building bid documents to Briglia and Solicitor Prevoznik.  Solicitor Prevoznik will review the insurance requirements in the bid documents.  Briglia will review the proposed dates on the invitation to bid.
Motion:  Konrath moved and seconded by Gonze to approve the advertisement through the PennBid Program contingent on Solicitor Prevoznik’s review of the insurance requirements.
Motion Carried 3-0.
Gonze inquired from Mr. Unangst an update on the culvert work done on Browns Hill Road.  Mr. Unangst will follow-up with Jason Smith.
Mr. Unangst submitted a comment letter from PennDOT regarding the Murray Highway Occupancy Permit.  Mr. Unangst stated that a resolution giving Briglia authorization to execute the M-950AA (HOP Application) is required. 
Motion:  Gonze moved and seconded by Konrath to adopt Resolution 03-2019 giving Briglia authorization to execute documents for the HOP and any other PennDOT forms requiring execution by the Township retroactive to January 1, 2019.
Motion carried 3-0.
Gonze inquired from Mr. Unangst the status of the signs at Rogues Path and Route 191 Traffic Signs.  Briglia stated that she would pull the information for the next Board of Supervisors meeting.

Public Hearing
Solicitor Prevoznik stated that Mr. Unangst and he reviewed the proposed Ordinance #260 and found that the triggers to require a traffic impact study were not included in the proposed ordinance. 
Motion:  Gonze moved and seconded by Konrath for Solicitor Prevoznik to work with Solicitor McManus and Mr. Unangst to revise the proposed ordinance.
Motion carried 3-0.

New Business (Continued)
Barrett Paradise Friendly Library
Konrath stated that a small section of the sidewalk at the Barrett Paradise Friendly Library needs to be removed and replaced.
Motion:  Gonze moved and seconded by Briglia to approve the road crew to do the necessary work to repair the small section of the sidewalk at the Barrett Paradise Friendly Library.
Motion carried 3-0.
Resolution 01-2019
Konrath stated that Resolution 01-2019 amends the fee schedule to include the Short-Term Rental Appeal Fee of $500.00.
Motion:  Gonze moved and seconded by Briglia to adopt Resolution 01-2019 as presented.
Motion carried 3-0.
Resolution 02-2019
Konrath stated that Resolution 02-2019 is to dispose of records per the Municipal Records Manual.
Motion:  Konrath moved and seconded by Gonze to adopt Resolution 02-2019 as presented.
Motion carried 3-0.

Reports (Continued)
Solicitor – Solicitor Prevoznik reported that the Most Holy Trinity Parish had submitted a consolidation plan for four parcels.  The Paradise Township Planning Commission recommended accepting the plans for review upon receiving an escrow check in the amount of one thousand dollars ($1,000.00) or the application would be considered incomplete.  Briglia stated that Most Holy Trinity Parish paid the escrow fee today.  Solicitor Prevoznik stated that a letter should be sent to the Most Holy Trinity Parish stating that the consolidation plan will be accepted at the Planning Commission’s next meeting on April 9 for review.
Motion:  Konrath moved and seconded by Gonze for Briglia to send the letter to Most Holy Trinity Parish stating that the lot consolidation plan would be accepted for review by the Planning Commission on April 9.
Motion carried 3-0. 
Solicitor Prevoznik stated that he has information on administrative search warrants that he will further discuss with the Board after the Township hires a new zoning officer.  Solicitor Prevoznik reported that he sent emails to Attorney Belardi and Dave Osborne reminding them that an updated matrix is due and that the Township is to be receiving monthly updates on the NPDES application.   Solicitor Prevoznik also reported that an email was sent to Attorney Belardi reminding him that the noise testing for the special events (concerts) for 2019 is due shortly. 
Solicitor Prevoznik stated that he would be meeting with Solicitor McManus to review the draft wireless communication facilities ordinance.
Solicitor Prevoznik inquired if the nuisance vehicle ordinance has been revised.  Konrath stated that the Planning Commission has concerns on vehicles owned by property owners for snow plowing purposes on their own properties that are not registered or insured.  Motion:  Gonze moved and seconded by Konrath to have Solicitor Prevoznik draft a nuisance vehicle ordinance.
Motion carried 3-0.
Solicitor Prevoznik reported that he would be drafting the decision for Tarpon Towers for the Board’s review.
Zoning Officer – The Board reviewed the Zoning Officer’s Report.  Brady was not in attendance to answer any questions. 
EAC/Open Space – Konrath stated that the meeting was reported on at the last Board meeting. 
PARC – Briglia submitted the progress report that was submitted to DCNR including a timeline for the Seven Pines Phase 1B grant.
Pocono Mountain Regional Emergency Medical Services (PMREMS) – Gonze reported that the new billing company and new bookkeeper are working out well.  Gonze reported that the finance reports will be based on actual revenues received and not billing less contractual allowance which is an estimate of revenues received.  Gonze also reported that a Building Committee has been established to look at renovations at Station 11-1.  
Gonze stated that a Golf Outing Fundraiser would be held on May 31 at the Buck Hill Golf Club.
 
Correspondence/Miscellaneous
There was no correspondence/miscellaneous for tonight’s meeting.

Other Business/Public Comment
Seasonal Employees
Briglia stated that she contacted Edwin McIntosh and Doug Lies and that Edwin McIntosh will not be returning this year as a seasonal employee for maintenance of the open space properties.
Motion:  Gonze moved and seconded by Konrath to place an ad in the Pocono Record, same as last year, for a seasonal employee
Motion carried 3-0.
