REGULAR MEETING MINUTES
SEPTEMBER 16, 2019

Call to Order

Chair Konrath called the meeting to order at 6:00 p.m.

Pledge of Allegiance
Konrath led the Pledge of Allegiance to the Flag.   
                             
Public Comment Statement
Konrath read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”
Konrath stated that the meeting is being recorded for the limited purpose of preparing the official minutes.

Approval of Minutes
Motion: Gonze moved and seconded by Konrath to approve the September 4, 2019 Board of Supervisors regular meeting minutes as presented.
Motion carried 3-0.

Treasurer’s Report
Briglia read the Treasurer’s Report.
Motion:  Gonze moved and seconded by Konrath to approve the Treasurer’s Report as presented.
Motion carried 3-0.

Work Session Items
Konrath reported that the Board reviewed the spreadsheet comparing the nine website redesign proposals received at the work session held earlier this evening.  The Board agreed to eliminate five of the lowest ranked companies due to cost or missing information requested per the proposal. 

Bids
Salt Storage Building – Mr. Unangst stated that three bids were received.  See Exhibit 1.  Mr. Unangst stated that he is waiting on references from the lowest bidder, Creekside Concrete Construction. 
Motion:  Gonze moved and seconded by Konrath to issue the notice of award to the lowest bidder upon favorable recommendations of reference to the Board of Supervisors.
Motion carried 3-0.

Unfinished Business
SFM Consulting – Gonze stated a satisfactory agreement has been reached with SFM Consulting for the position of Zoning and Codes Enforcement Officer.
Motion:  Gonze moved and seconded by Briglia to adopt Resolution 08-2019 appointing SFM Consulting as the Zoning and Codes Enforcement Officer for the Township adopting the Consulting Services Agreement with Exhibits (Zoning and Codes Enforcement Officer Job Description and Zoning Administrator Job Description) at the rate of $65.00 per hour for a minimum of nine (9) office hours per week starting the week of September 23 and to be sworn in before starting.
Motion carried 3-0. 
Timber Harvesting Proposed Ordinance – Mr. Unangst stated that the Paradise Township Planning Commission has recommended that the proposed timber harvesting ordinance be adopted. 
Motion:  Gonze moved and seconded by Briglia to send the proposed timber harvesting ordinance to the Monroe County Planning Commission for review.   
Motion carried 3-0.
Motion:  Briglia moved and seconded by Gonze to hold a public hearing for the timber harvesting proposed ordinance on Wednesday November 6, 2019 at 6:30 p.m. 
Motion carried 3-0.

Public Hearing-Proposed Ordinance #260
Motion:  Konrath moved and seconded by Briglia to recess the regular meeting and open the public hearing for the proposed Traffic Impact Study Ordinance #260.
Motion carried 3-0.
Solicitor Prevoznik stated that the purpose of Ordinance #260 replaces the existing Traffic Impact Study standards with improved standards to identify traffic and transportation problems associated with proposed uses and delineate solutions. Solicitor Prevoznik stated that the proposed ordinance was scheduled for tonight at 6:30 p.m.  Solicitor Prevoznik summarized the advertised public notice for proposed Ordinance #260 (See Exhibit 2).  Solicitor Prevoznik submitted the following Exhibits:
T-1  –  Proposed Ordinance #260.
T-2  –  Public Notice.
T-3  –  Proof of Public Notice from Pocono Record.
T-4 –  Memo from Reda Briglia, Secretary, stating that the proposed ordinance was delivered to the Monroe County Planning Commission, Monroe County Law Library, Pocono Record, and posted at the municipal building.
T-5  –  Paradise Township Planning Commission minutes dated January 18, 2019.
T-6  –  Paradise Township Planning Commission minutes dated May 14, 2019.
T-7  –  Paradise Township Planning Commission minutes dated August 13, 2019.
T-8  –  Monroe County Planning Commission review dated August 13, 2019.
T-9  –  Sign-in Sheet.
Mr. Unangst was sworn in.  Mr. Unangst testified that the triggers requiring a Traffic Impact Study are included in the proposed ordinance and answered the comments from the Monroe County Planning Commission.  Mr. Unangst explained the Level of Service A-F of the Highway Capacity Manual.     
Solicitor Prevoznik asked if the Board had any questions.  The Board had no questions.  Solicitor Prevoznik asked if any member of the public wished to discuss the Ordinance.  No one participated or signed the sign-in sheet.
Motion:  Gonze moved and seconded by Briglia to move Exhibits 1 – 9 into the record.    Motion carried 3-0.
Motion:  Briglia moved and seconded by Gonze to close the public hearing and reconvene the regular meeting.
Motion carried 3-0.
Motion:  Briglia moved and seconded by Gonze to adopt Ordinance #260 as advertised.
Motion carried 3-0.
 
New Business
Pa. Municipal Retirement System Minimum Municipal Obligation
Briglia stated that Act 205 of 1984, as amended, requires all municipal pension plans to inform the governing body of the municipality of the plan’s expected financial obligation for the upcoming year.  Briglia stated that she has completed the 2020 Minimum Obligation Work sheet for 2020.
Motion:  Gonze moved and seconded by Konrath to approve the 2020 Minimum Obligation Worksheet showing an obligation of $50,840.00.
Motion carried 3-0.
Planning Commission  
Gonze stated that he has received three names of companies that provide land use and planning services if the Township needs to hire an outside firm to provide ordinances services for the Township.  The companies are Urban Research and Development Corporation, Bethlehem, PA; Shepstone Management Company, Honesdale, PA; and Community Planning and Management LLC, Paupack, PA.  Briglia was asked to contact these companies for their fee/rate schedules.
 
Planning Commission Items
Mr. Unangst stated that the Planning Commission has been reviewing the Tarpon Towers Land Development Plan and the Wireless Communications Facilities draft ordinance.  Mr. Unangst reported that the Planning Commission has recommended that the Board draft an ordinance regarding Animal Husbandry Home Use for chicken/fowl.  Mr. Unangst also reported that the Planning Commission has recommended to the Board of Supervisors to restrict Short Term Rentals in the townships residential areas to only owner occupied houses, and engage a third party planner to help assist with drafting an ordinance that would also take the townships existing codes into account.  The Board discussed the Short-Term Rental recommendation and decided to invite the Planning Commission to the next Board of Supervisors work session to discuss this further. 

Reports
Solicitor – Solicitor Prevoznik reported he has received the revised License Agreement from Richard Williams for Tarpon Towers and that the revised agreement now includes the Conditional Use requirements. 
Engineer – Mr. Unangst reported that he would follow-up with Altronics regarding the locks for the proposed foyer.

Correspondence/Miscellaneous
Barrett Paradise Friendly Library -– Gonze stated that a thank you note has been received from the Barrett Paradise Friendly Library for the sidewalk work completed by the Township.
Layton Family – Gonze stated that a thank you note was also received from the Layton Family for honoring them as Citizen-of-the-Year.

Other Business/Public Comment
Paradise Discovery Park – Konrath stated that he would be contacting Mike Mader to move forward with installing the drive at Paradise Discovery Park. 
Lighting Ordinance Review – Konrath reported that a resident has recommended that the Township’s lighting ordinance be reviewed.  The Board agreed that the resident should attend a Planning Commission meeting to discuss.
Mt. Airy #1, LLC Concerts – Mr. Garber was present and stated that the last two Mt. Airy #1, LLC concerts were very loud.  Solicitor Prevoznik will add this to the list for discussion with Mt. Airy #1, LLC representatives. 
UGI/Burton Road – Mr. Garber also reported that UGI Utilities have dug up a portion of Burton Road and that the Roadmaster should check Burton Road.
