OCTOBER 5, 2020

Call to Order
Chair Konrath called the meeting to order at 6:00 p.m.
Konrath read the public comment statement “To meet the requirements established by the Office of Open records for virtual meetings, this meeting shall be audio and video recorded via GoToMeeting.com from the initial announcement of the meeting till its end with the exception of the executive session if any, which shall not be recorded. Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand and we will also watch for you on chat, and you will be recognized.”

Motion: Briglia moved and seconded by Gonze to approve the September 21, 2020 Board of Supervisors regular business meeting minutes as presented.
Motion carried 3-0.
Motion: Konrath moved and seconded by Gonze to approve the September 30, 2020 Board of Supervisors Special meeting minutes as presented.
Motion carried 2-0. (Briglia abstained due to absence)

Other Business/Public Comment
Eric Hockman/Comprehensive Map Change – Resident Eric Hockman was present to discuss the progress of the proposed districting changes to the Township Zoning Map for areas which affect his property, specifically Woodland Road and Meadowside Drive.  Mr. Hockman is seeking to have the zoning in this area changed from residential to commercial.  Mr. Konrath stated that the rezoning of various areas of the Township, in accordance with the Comprehensive Plan is now in front of the Planning Commission.  A discussion was held on how a proposed zoning change for a portion of Route 390 also made it in front of the Planning Commission when Mr. Hockman had made his initial request much earlier this year. The Board restated that the matter was now in front of the Planning Commission and until a recommendation was sent to the Board, the Board would not take a position.  The Board recommended to Mr. Hockman that he follow up with the Planning Commission as proposed changes to the Zoning Map are on its agenda for its upcoming meeting on Tuesday, October 13, 2020. Mr. Hockman also asked whether the changes to the Short-Term Rental Ordinance would include the incorporation of one of the property maintenance codes.  It was discussed that recommendations were made to the Planning Commission which could be found on the Township’s Website once the prior meeting Minutes were posted but the recommendations did not include adding a property maintenance code.

Unfinished Business
Traffic Calming Devices – Mr. Unangst explained to the Board that Russell Horn from Paradise Falls Lutheran Association was requesting that the Traffic Calming Devices locations be changed from the original planned locations. The Board discussed the possible location changes. Mr. Unangst and Konrath will meet with Russell Horn from Paradise Falls Lutheran Association to further discuss the possible location changes.

Seven Pines Park Grant Bid – The Board discussed rescinding the bid previously awarded at the September 21, 2020 Board meeting due to a mathematical error discovered on the Seven Pines Park Phase 1B Grant Bid documents. The Board further discussed awarding the bid at the Base Bid Amount of $449,000.00. The project would be underfunded by approximately $98,000.00 plus further possible engineering costs. Briglia has not been contacted by Barrett Township in regard to Barrett Township contributing up to an additional $30,000.00 in costs to complete the project. The Board also discussed using funds from the Open Space Fund account to cover the additional costs needed to complete the Sevens Pines Park Phase 1B Grant Project.  It was noted that even with the corrected bid amounts, Kobalt Construction was still the lowest bidder for both base bid and alternate bid.
Motion: Gonze moved and seconded by Konrath to rescind the bid previously awarded at the September 21, 2020 in the amount of $417,000.00 for the Seven Pines Park Phase 1B Grant Project due to a mathematical error on the bid documents.
Motion carried 3-0.
Motion: Gonze moved and seconded by Konrath to allocate up to $105,000.00 from the Open Space funds towards the Seven Pines Park Phase 1B Grant Project.
Motion carried 3-0.
Motion: Gonze moved and seconded by Briglia to award the lowest total base bid in the amount of $449,000.00 to Kobalt Construction contingent upon satisfaction of the engineer and solicitor that all required bid documents have been completed and are compliant with the bid requirements.
Motion carried 3-0.

New Business
Trick or Treat – The Board discussed whether to have Trick or Treat this year. The Board discussed setting the hours for Trick or Treat at 6:00 p.m. to 8:00 p.m. on Saturday, October 31, 2020. Konrath asked Transue to post the times on the Township website and on Savvy Citizen.

Reports
Roadmaster – No report.

Solicitor – Solicitor Prevoznik stated that he just received and forwarded to the Board an emailed answer from American Legal; however, he had not reviewed it as of the meeting. Solicitor Prevoznik stated that he sent a list of questions to the Monroe County Voter Registration Office regarding proper conduct to be followed by the Constable and poll workers while working on the day of election in response to issues that were raised by the Minority Inspector of Elections from Election Day on June 2, 2020. Solicitor Prevoznik stated the Voter Registration office forwarded to him guidelines which they have sent to Constables which are in effect while the Constable is working on Election Day. Solicitor Prevoznik also stated that the Office of Voter Registration would get back to him with the answers to the questions he submitted.

Engineer – Charles Unangst discussed the cost proposal for the replacement of the Devils Hole Road Culvert at Tank Creek. The proposal was submitted for budget consideration for the 2021 Budget Year.

Correspondence/Miscellaneous
Transue stated that she contacted County Waste to order the change of dumpsters for the EMS Building located at 425 Woodland Road. The service agreement for the new dumpster has a five year term of service with a 6 month buyout if the Township changed vendors. The Board discussed whether County Waste had been sold and was being run by a new owner. Transue is to contact County Waste to find out if the Company had been sold and what those implications would be if we signed a five year service agreement with an unknown company.
