Short Term Rentals Not Permitted in Residential Zoning Districts

Amended Ordinance 273 Short-Term Rental Zoning District Changes was adopted at the January 17, 2022 Board of Supervisors meeting.

This Hearing has been continued to January 17, 2022 at 6:30 p.m. Amended Ordinance No. 273:

ORDINANCE NO. 273

AN ORDINANCE OF THE TOWNSHIP OF PARADISE, MONROE COUNTY, PENNSYLVANIA, TO REVISE CHAPTER 160, to wit: §160-12 (Special land use requirements) and Section §160-71(C) (Resort Development Area Overlay District), and Zoning Schedule I, SCHEDULE OF REGULATED LAND USES, OF THE CODE OF ORDINANCES OF PARADISE TOWNSHIP.

AND NOW, the Board of Supervisors of Paradise Township hereby enacts and ordains, and it is hereby ENACTED and ORDAINED as follows:

SECTION 1.  The Code of Ordinances of Paradise Township (the “Code”) is hereby amended to add to §160-12(A)(43-B)(h) a new subsection to wit, §160-12(A)(43-B)(h)[5] to the Code, as follows:

[5] Short-term rentals in compliance with Section 160-12(A)(64-A) and subject to the standards therein.

SECTION 2.  §160-12(A)(43.B)(a) of the Code is hereby amended to state: “Master Developments are permitted as conditional uses within the Resort Development Overlay District described in Article XII of this Chapter.”

SECTION 3.  §160-71(C) of the Code is hereby amended to state: “Overlay District Concept: The Resort Development Area district described above shall be an overlay to the existing underlying districts as shown on the Official Zoning Map, and as such, the provisions for the Resort Development Area District shall replace the underlying district provisions when the developer elects the Resort Development Area District option.  Where a lot owner selects the Resort Development Area District option, the entire parcel must be developed in accordance with Article XII.” 

SECTION 4.  Zoning Schedule I, SCHEDULE OF REGULATED LAND USES, of the Code of Ordinances of Paradise Township (the “Code”) is hereby amended to revise in which zoning districts Short-Term Rentals are permitted, as follows:

SECTION 5.  The provisions of this Ordinance shall be severable. If any of the provisions hereof shall be invalid or unenforceable, the remaining provisions of the Ordinance shall remain in full force and effect.

SECTION 6.  All ordinances or parts of ordinance conflicting with or inconsistent with the provisions of this Ordinance are hereby repealed, but only insofar as the same are in direct conflict or directly inconsistent with this Ordinance.

SECTION 7.  This Ordinance shall be effective five (5) days after enactment.

AMENDED NOTICE OF PUBLIC HEARING

TO ENACT PROPOSED ORDINANCE NO. 273

 

 

TAKE NOTICE that the Paradise Township Board of Supervisors will hold a public hearing for the enactment of proposed Ordinance No. 273 (the initial version of which has now been amended to also correct certain typographical errors in the citation of Code sections regarding master developments and resort overlay districts), on Monday, January 17, 2022, at 6:30 p.m.  The hearing on Ordinance No. 273 shall run concurrent with the hearing which was continued at the hearing held on December 6, 2021 for proposed Ordinance No. 273. The hearing will be convened during the regular meeting of the Board of Supervisors which starts at 6:00 p.m., at the Paradise Township Municipal Building, 5912 Paradise Valley Road, Paradise Valley, PA.  After the hearing and during the continuance of the regular meeting, the Board will consider, if in order, the passage of Ordinance No. 273 as well as other business coming before the Board at that time.  The full text of the proposed Ordinance No. 273 with amendments is, as follows:
