Call to Order

Vice-Chair Michaels called the December 14, 2010 Planning Commission meeting to order at 5:32 PM.  The meeting was held at the Paradise Township Municipal Building, Route 940, Paradise Valley, Cresco, PA. 

 

Public Comment Statement

Vice-Chair Michaels announced the following public comment statement: “Ladies and gentlemen, before the Planning Commission votes on any matter, the Commission will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.”  (At that time, please state your name for the record.)

 

Approval of Regular Meeting Minutes

Motion:  Montgomery moved seconded by Michaels to approve the November 9, 2010 Regular Meeting Minutes as presented.

Motion carried 4-0.

Other Business

Chapter 110 – Sewage Disposal

Birdsall reviewed new, additional proposed revisions to Chapter 110, Chapter 1, Chapter 160 and Chapter 131 associated with regulation of Sewage Disposal.  Typographical errors were corrected.  Discussion took place regarding the revised definition of a Public Sewage Facility.

Motion:  Taylor moved to recommend approval of the revisions to Chapter 1, Chapter 110, Chapter 131 and Chapter 160 associated with regulation of Sewage Disposal.  Stevens announced she would abstain from any vote that would exclude a municipal authority from the definition of a Public Sewage Facility due to on-going litigation.  Motion died for lack of second.

Motion:  Taylor moved to amend his previous motion to recommend approval of the revisions to Chapter 110, Chapter 131 and Chapter 160, and to recommend approval of the revisions to Chapter 1 but to add “Paradise Township and a municipal authority of which Paradise Township is a member” to the definition of Public Sewage Facility.  Motion seconded by Montgomery.

Motion carried 4-0.

 

Chapter160 – Solar Energy Systems

Brady reminded the Commission that this proposed revision was reviewed previously, and that questions remained regarding the language associated with glare.  Discussion took place regarding glare.

Motion:  Stevens moved seconded by Montgomery to recommend approval of the revision to Chapter 160 associated with Solar Energy Systems.

Motion carried 4-0.

 

Chapter 160-Agriculture

Brady reminded the Commission that this proposed revision was reviewed previously, and that questions remained regarding the language associated with chickens and roosters.  Discussion took place regarding a number of minor revisions.

Motion:  Stevens moved seconded by Taylor to recommend approval of the revisions to Chapter 1 and Chapter 160 associated with agricultural uses, to include the minor revisions discussed and the reduction of the minimum lot size for the keeping of fowl from five (5) acres to two (2) acres.

Motion carried 4-0.

 

Marcellus Shale Drilling

Questions were posed to Attorney McManus regarding municipal regulation of Marcellus Shale Drilling.  McManus noted various ordinances were being challenged in court.  Brady noted that PSATS was about to release a model ordinance for use by municipalities.

 

There being no further business or comment, the meeting was adjourned.

 

Motion: Stevens moved seconded by Taylor to adjourn the meeting at 7:10 PM

Motion carried 4-0.
