PARADISE TOWNSHIP BOARD OF SUPERVISORS

REGULAR MEETING MINUTES

NOVEMBER 16, 2010

 

Call to Order

Chair Troutman called the meeting to order at 6:00 p.m.

 

Roll Call

Officials Present:

Louise Troutman – Chair

Michael Flood – Vice Chair

Reda Briglia – Secretary-Treasurer

John C. Prevoznik – Solicitor

Charles Unangst – Engineer

Debra Brady – Zoning Officer

 

Pledge of Allegiance

Chair Troutman led the Pledge of Allegiance to the Flag.

 

Public Comment Statement

Chair Troutman read the public comment statement “Ladies and gentlemen, before the Board of Supervisors votes on any matter, the Board will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.  A public comment period will be held at the end of the regular agenda for any other business.”

 

Approval of Minutes

Motion:  Flood moved and seconded by Briglia to approve the November 8, 2010 Board of Supervisors regular meeting minutes and the November 11, 2010 special meeting minutes as presented.

Motion carried 3-0.

 

Treasurer’s Report

Briglia presented the Treasurer’s Report as attached. 

Motion:  Flood moved and seconded by Troutman to approve the Treasurer’s Report as submitted.

Planning Commission Items

Sewage Facilities Proposed Ordinance – Brady stated that the proposed ordinances for the sewage facilities are ready to advertise for public hearings. 

Motion:  Briglia moved and seconded by Flood to schedule the public hearings for Chapter 1 and Chapter 110 on December 21 at 7:00 p.m. and 7:15 p.m. respectively.

Motion carried 3-0.

Vehicles and Traffic – Brady stated that the proposed ordinances to include bridge maximum gross weights on Hulbert Hill Road and Koerners Road are ready to advertise for public hearings. 

Motion:  Briglia moved and seconded by Flood to schedule the public hearings for Chapter 1 and Chapter 142 on December 21 at 6:30 p.m. and 6:45 p.m. respectively.

Motion carried 3-0.

The Board discussed the definition of Sewage Facility, Public.  The Board agreed to change the definition to read:  Community sewage owned and/or operated by a public utility.

 

New Business         

          Infantine/Szczesniak – Attorney Wiesmeth was present with his clients, Richard Infantine and Joanne Szczesniak.  Attorney Wiesmeth requested the Board consider rezoning the Infantine/Szczesniak  property on Woodland Road.  Attorney Wiesmeth showed the Board that the Infantine/Szczesniak property is surrounded by Mt. Airy #1 parking lots.   Attorney Wiesmeth stated that the property owners have not been able to keep a tenant due to the noise from the busses.  The Board asked Brady what uses are currently permitted in the R-2 district.  After discussion, the Board agreed to review the information further.

          Proposed 2011 Budget – The Board reviewed the proposed 2011 budget with the updated revisions from the previous meeting.  The Board made additional changes.

Motion:  Troutman moved and seconded by Flood to advertise the 2011 proposed budget with the additional changes that includes $5,000.00 for the Paradise Township Historic Society after they obtain their 501C3 status, and $50,000.00 for the Friendly Community Center if Attorney Prevoznik’s research shows that it is a permissible appropriation by the Second Class Township Code.

Motion carried 3-0.

          Lower Gimme Shelter Road – Mark and Delores Williams were present.  Briglia stated that the residents on Lower Gimme Shelter Road had presented a petition to have the road name changed to either Gary, Forest, or Leaf Lane.  The Board approved the road name change to Forest Lane.  Brady will follow-up with the County to change the name.

          Holiday Observance – Briglia stated that Christmas and New Year’s fall on Saturdays and per the union contract, holidays falling on a Saturday, shall be observed on Friday.  Briglia stated that both Fridays are also holidays, Christmas Eve and New Year’s Eve and asked if these holidays should be observed on the Thursday prior to Christmas Eve and New Year’s Eve or the following Mondays.  Flood stated that since the holidays are actually on Saturday the residents would expect the Township to be

open on the following Mondays.  The Board agreed that the holidays should be observed on Thursday, December 23 and Thursday, December 30

 

Solicitors Report

          Solicitor Prevoznik stated the he had no report for this evening.

 

Unfinished Business

          Troutman stated that there was no unfinished business.

 

Correspondence/Miscellaneous

Troutman stated that there was no unfinished business.

 

Other Business/Public Comment

          Troutman asked if there was any further business or public comment.  Briglia stated that she attended the Emergency Operations Plan meeting at the Monroe County Public Safety Center on November 15 and reminded Troutman and Flood that the Township must become National Incident Management System (NIMS) compliant or would lose state and federal funding including the State Highway funding.  Briglia stated she had taken four courses, NIMS 100, 200, 300, and 700.  Briglia stated that either Troutman or Flood would need to take the NIMS 100 and 200. 

         

AT & T Conditional Use – Public Hearing

Motion:  Briglia moved and seconded by Flood to recess the regular meeting and open the public hearing at 7:00 p.m.

Motion carried 3-0.

Attorney Prevoznik explained that the conditional use hearing for AT & T is to collocate twelve (12) AT & T telecommunications antennas on the existing 150’ monopole owned by Verizon Wireless, enlarge the existing fenced equipment compound, construct an 11 ½’ by 20’ equipment building and all associated equipment, facilities, and wiring.  Solicitor Prevoznik called Brady as the Township’s witness.  Attorney Durso called witnesses for AT & T.  The Board considered the evidence presented and agreed to announce their decision at the next regular Board meeting on December 7, 2010 at 7:00 p.m.

Motion:  Briglia moved and seconded by Flood to continue the AT & T Conditional Use Hearing to December 7, 2010 at 7:00 p.m.

Motion carried 3-0.

 

Motion:  Briglia moved and seconded by Troutman to reconvene the regular meeting.

Motion carried 3-0.

 

Mt. Airy Curative Amendment

Solicitor Prevonzik stated that the Mt. Airy Curative Amendment mediation meeting has been tentatively scheduled for Saturday, December 18 at 9:00 a.m. with Saturday, January 8 at 9:00 a.m. as the alternate date.

Motion:  Briglia moved and seconded by Flood to advertise the Mt. Airy Curative Amendment meeting for Saturday, December 18 at 9:00 a.m. with Saturday, January 8 at 9:00 a.m. as the alternate date.

Motion carried 3-0.
