Call to Order

Chairman Greco called the October 12, 2010 Planning Commission meeting to order at 5:30 PM.  The meeting was held at the Paradise Township Municipal Building, Route 940, Paradise Valley, Cresco, PA. 

 

Public Comment Statement

Chairman Greco announced the following public comment statement: “Ladies and gentlemen, before the Planning Commission votes on any matter, the Commission will allow for public comment on that particular item.  If you wish to be heard at that time, please raise your hand, and you will be recognized.”  (At that time, please state your name for the record.)

 

Approval of Meeting Minutes

Motion:  Montgomery moved seconded by Michaels to approve the Minutes from the September 14, 2010 Regular Meeting as presented.

Motion carried 5-0.

New Submittals for Acceptance

 

Verizon/AT&T Conditional Use Permit Application

Brady explained that the Township has received an application to co-locate an AT&T Mobility antenna on the existing Verizon Wireless cellular tower on the Vogt property on Rt. 390.  The application names Verizon Wireless as the applicant as owner of the tower.  The application includes a letter from Verizon Wireless authorizing Attorney Catherine E. N. Durso, representing AT&T Mobility, to act as agent for Verizon Wireless for this application.

Motion: Raczko moved seconded by Stevens to accept the Conditional Use application for review. 

Motion carried 5-0.

Chapter 142 Revisions

Brady explained that the proposed revision to Chapter 142 would remove two weight restrictions for streets currently listed in Chapter 142 and add three new weight restrictions – one for Koerners Road and two for bridges on Koerners and Hulbert Hill Roads based on engineering evaluations.  Discussion ensued regarding appropriate enforcement language.   Also proposed was a revision to Chapter 1 to include a definition for “Local Traffic.”

Motion: Raczko moved seconded by Greco to recommend approval of the proposed revision to Chapter 142 contingent on inclusion of enforcement provisions compliant with the Vehicle Code and elimination of alternately proposed civil enforcement provisions.

Motion carried 5-0.

Motion:  Raczko moved seconded by Stevens to recommend approval of the proposed revision to Chapter 1 to include the new definition for “Local Traffic.”

Motion carried 5-0.

 

Chapter 160 Revisions

Brady explained that, along with new zoning standards for solar energy systems, this proposed revision to Chapter 160 corrects an error found in Section 160-12(A)(27)(g) regarding street bonding for timber harvests.  Discussion ensued regarding solar systems.  Stevens questioned the need for language requiring solar panels to be placed such that concentrated solar radiation or glare would not be directed onto nearby properties or roadways.  Unangst explained that if glare became problematic, the panel could be adjusted or a shield could be installed.  Brady agreed to further investigate the issue.

Motion:  Stevens moved seconded by Raczko to table the revision until the next meeting.

Motion carried 5-0.

 

Chapter 160 and related Chapter 1 Revisions

Brady asked the Commission how they wanted the ordinance to address chickens in the Section pertaining to agriculture.  Discussion ensued regarding minimum lot sizes, grazing needs for large animals, setbacks and free range chickens versus coop chickens.  Brady was directed to conduct additional research.

Motion: Stevens moved seconded by Michaels to table the revision until the next meeting.

Motion carried 5-0.

 

Chapter 110 and related Chapter 1 Revisions

Brady explained that she had been directed to revise Chapter 110 and related definitions to provide standards for community sewage disposal systems.  Discussion ensued regarding community sewage disposal systems and the proposed standards.  Greco recommended that the Township include a requirement that the owner/operator provide a copy of the draft NPDES permit, the final NPDES permit and any modifications to the NPDES permit. The term “discernable odors” was discussed.  Brady noted that the proposed revision would also include a sentence requiring compliance with well head protection standards located in Chapter 160 (Zoning).

Motion:  Montgomery moved seconded by Raczko to accept the proposed revisions for review.

Motion carried 5-0.

 

There being no further business or comment, the meeting was adjourned.
